1.1 Below are important Terms and Conditions and Terms of Use that apply to anyone who visits our website (‘website visitors’ or ‘visitors’) or uses our services (‘service users’ or ‘users’). It is important to note that these Terms and Conditions and Terms of Use focus on users and visitors in the United Kingdom (UK), where Doctor Ho Limited’s (or ‘our’) service is based and provided. These Terms and Conditions and Terms of Use may apply to users and visitors from other countries if these Terms and Conditions and Terms of Use can be valid and applicable in the respective region or geographical area. These Terms and Conditions and Terms of Use are legally bound between Doctor Ho Limited and visitors/ users of our services; and they are necessary to protect both you (i.e. our website visitors and service users) and us.

 

1.2 Doctor Ho Limited offers a range of courses for parental learners and healthcare professionals. The Terms and Conditions and Terms of Use are outlined separately for Courses for Parental Learners, and for Healthcare Professionals as follows.

1.3 Please visit our website and/or use the services offered in Doctor Ho Limited only if you fully understand and agree to its Terms and Conditions and Terms of Use (and Privacy Policy and Cookies Policy). By using, joining and/or registering to any of our courses and/or services, you give and affirm your informed consent to all of these Terms and Conditions and Terms of Use (and Privacy Policy and Cookies Policy).

2. Terminology

 

2.1 The ‘service users’ or ‘users’/ you: refer to users to our services, including those who enrol, pay the course fee and join any of our courses.

 

2.2 The ‘website visitors’ or ‘visitors’/ you: refer to those who visit or browse our website.

2.3 The Courses/ Services: Courses and services maybe interchangeable terms. Courses refer to courses offered to parents (or ‘Courses for Parental Learners’).

 

2.4 The Course Fees: refer to the Course Fees (or Fees) for the respective courses as shown on our website.

 

3. Our purposes

 

3.1 Regarding our Courses for Parental Learners, Doctor Ho Limited aim to support parents’ learning about well infant and child development by providing online courses. Our Courses for Parental Learners do not make any diagnosis, give personalised health advice or advise any treatment to individuals; therefore this service is not intended for use by parents who are seeking medical consultation, specific medical advice or treatment for their children or any other children.

 

4. Legal agreement, the offering and binding of terms

 

4.1 These Terms and Conditions and Terms of Use set forth the entire Terms and Conditions and Terms of Use applicable to all service users and website visitors of Doctor Ho Limited. Our Courses for Parental Learners support parents’ learning about well infant and child development by providing online courses; these courses do not make any diagnosis, give personalised health advice or advise any treatment to individuals; therefore this service is not intended for use by parents or those who are seeking medical consultation, specific medical advice or treatment for their children or any other children.

  

4.2 You may visit our website, book a course and use the services provided by Doctor Ho Limited only if you have fully acknowledged, read, understood and agreed to be bound by our Terms and Conditions and Terms of Use (and Privacy Policy and Cookies Policy). By visiting our website, using services and/or enrolling any of our courses, you give and affirm your informed consent to these Terms and Conditions, and Terms of Use (and Privacy Policy and Cookies Policy).

 

4.3 We reserve the rights to update and/or amend our Terms and Conditions and Terms of Use (and Privacy Policy and Cookies Policy) at any time. If we do so, we will provide such updates on our website - so please review it frequently. Where applicable and possible, we may inform and communicate with our (returning) service users in writing (e.g. by email/ newsletter on our website) about any changes in our Terms and Conditions and Terms of Use (and Privacy Policy and Cookies Policy) if we have their contact details. Please note that changes and clarifications will take effect immediately upon their posting on the website.

5.1 In order to join our courses and/or receive our services:

 

1) You must be 18 years of age or above, or of the legal age of majority in your jurisdiction, and possess the legal authority, rights and freedom to enter into these Terms and Conditions, Terms of Use, Privacy Policy and Cookies Policy as a binding agreement. You must not join our courses and/or receive our services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

2) You must acknowledge, understand and agree that our courses for parental learners do not make any diagnosis, give personalised health/ medical advice or advise any treatment to individuals. Therefore, our courses for parental learners are not intended for use by parents or those who are seeking medical consultations, specific/ personalised medical advice or treatment for their children or any other children.

 

3) You must acknowledge, understand and agree that if the course and published materials contain medical information or advice, the information or advice provided is as accurate and as comprehensive as possible, but that it is only general advice and should not be used as a substitute for the individual advice participants might receive from consulting their own doctor.

 

4) You must acknowledge, understand and agree that all parts of the course or published materials are not intended to be used to aid, form or reach diagnoses, clinical decisions/ activities, clinical management or treatment plan to any specific individuals. If the course or published materials is being read by healthcare professionals and clinicians, it is up to them to use their own clinical judgement when interpreting such information and deciding how best to apply it to the consultation or treatment of patients.

6. Privacy

 

6.1 Our services may require or involve the submission, collection and/or use of certain personally identifying or identifiable information. Please read carefully about our Privacy Policy. Please use the services or book a course provided by Doctor Ho Limited only if you have fully acknowledged, read, understood and agreed our Privacy Policy (as well as our Cookies Policy, Terms and Conditions and Terms of Use). If you have further questions about our Privacy Policy, please feel free to contact us by using our online contact form.

 

7. Regarding our courses for parental learners

 

7.1 You must fully acknowledge, understand and agree that our courses for parental learners provide only general information and knowledge about well infant and child development. These courses solely aim to support parents who would like to learn more about well infant and child development in general, and these courses do not provide information, knowledge, advice or consultations specific to the care for their children or any individual children. Therefore, you must fully understand and agree that our courses for parental learners are not intended for use by parents or those who are seeking medical consultation, specific medical advice or treatment for their children or any other children.

 

7.2 Our courses for parental learners do not make any diagnosis, give personalised health advice or advise any treatment to individuals.

 

7.3 You must fully acknowledge, understand and agree that our courses for parental learners do not involve any formal training/ education or assessment. In addition, our First Aid in Children course is not a certified course and does not involve any formal training to deliver professional paediatric first aid or resuscitation.

 

7.4 You must fully acknowledge, understand and agree that our courses for parental learners are not accredited training courses and therefore we do not issue course certificates. However, if you have attended the whole course and would like to request for a course attendance record which outlines the online course and date you have attended, we can send a course attendance record to you to your email which you have provided.

 

7.5 You must fully acknowledge, understand and agree that the content of our courses for parental learners tailors to parental learners residing in England, UK.

 

7.6 You must fully acknowledge, understand and agree that we do not take any responsibilities if parts or full content of the courses for parental learners may not be relevant for you or to your learning needs. In addition, by enrolling and joining the course, you must fully acknowledge and understand that the content of our courses for parental learners is not validated by any independent bodies and may not be most updated or consistent with the literature.

7.7 You must acknowledge, understand and agree that if the course and published materials contain medical information or advice, the information or advice provided is as accurate and as comprehensive as possible, but that it is only general advice and should not be used as a substitute for the individual advice participants might receive from consulting their own doctor.

 

7.8 You must acknowledge, understand and agree that all parts of the course or published materials are not intended to be used to aid, form or reach diagnoses, clinical decisions/ activities, clinical management or treatment plan to any specific individuals. If the course or published materials are being read by healthcare professionals and clinicians, it is up to them to use their own clinical judgement when interpreting such information and deciding how best to apply it to the consultation or treatment of patients.

 

7.9 Please read the course descriptions and contact us if you have any questions about our courses. By visiting our website, using services and/or enrolling any of our courses, you give and affirm your informed consent to our Terms and Conditions, Terms of Use, Privacy Policy and Cookies Policy.

 

8. General education related matters

 

8.1 Doctor Ho Limited has the sole rights to design and organise the curriculum and topics of each course and its delivery. Please contact us if you have any specific requirements, suggestions or questions about any aspect of the courses, although we may not be able to meet your requests or suggestions.

 

8.2 Doctor Ho Limited shall have the sole rights to change or adjust the course content without any prior notice.

 

8.3 We reserve the rights to cancel, reschedule or change the time of our courses, and should it happen, we will notify all the participants by phone/email at the earliest time possible.

 

8.4 Courses are delivered livestream according to the schedule advertised on our website. Should any users miss or join late in our course, we will not refund or reschedule any part of the courses.

8.5 Our courses for parental learners are conducted in a small group unless specified. This is because we would like to allow learners/ participants to have more opportunities for questions and discussion when they would like to. Both parents are invited to join our courses. We reserve the rights to close the course enrolment once the class has reached its maximum size. We reserve the rights to enrol more participants at our discretion.

 

8.6 All of our courses are conducted in English unless otherwise stated.

 

8.7 Please note that we do not provide references for our course participants.

 

8.8 We do not tolerate any abusive and aggressive behaviour, attitude or languages towards our staff or other course participants. In such events, we reserve the sole rights to remove any participants from our courses and service, and there will be no refund of any course fees. In addition, we reserve the sole rights to prevent individuals to enrol or join our courses.

 

9. You agree and undertake to:

 

9.1 Fully comply with all applicable laws and any other contractual terms which govern your use of our services (and any related interaction or transaction).

 

9.2 Be solely responsible and liable with respect to any of the uses of our services which occur under your user account and/or user platform(s) where applicable.

 

9.3 Regularly update your computer or similar devices and their software, and Internet security to prevent any harmful viruses which can potentially damage your computer/ devices and Internet platform, and our website, or affect other users.

10. You agree and undertake not to:

10.1 Copy, store, share, modify, create derivative works of, adapt, download, sell or transmit any of our website or courses content or materials to others for any purposes.

 

10.2 Record, share, reproduce, broadcast, stream, or make available of our courses (or any of their content) to others in any media, website, network or system for any purposes.

 

10.3 Conduct or involve in any activities which may be deemed as defamatory (including those actions which might be perceived as damaging to Doctor Ho Limited reputation and goodwill or which may bring Doctor Ho Limited into disrepute or harm), libellous, obscene, harassing, threatening, incendiary, abusive, racist, offensive, deceptive or fraudulent.

 

10.4 Encourage criminal or harmful conduct, or which otherwise violates the rights of Doctor Ho Limited, including any intellectual property rights, privacy rights, contractual or fiduciary rights.

 

10.5 Use any of our company’s rights, brand name, logos, word-/ trade- marks, domain and/or variations and misspellings thereof for any purposes.

 

10.6 Attempt to save any personal, financial or sensitive data/ information in our website, as we are not liable to any loss or misuse of your personal, financial or sensitive data/ information, or any financial loss as a result.

 

10.7 Use any illegal means or methods to generate or obtain one’s login data and/or passwords, including third parties, software or services.

 

10.8 Phish, store, collect, upload, share, or publish another person’s personal, credit or debit card or any other form of financial information in our website.

 

10.9 Falsely represent our values and meanings by spreading misinformation about our services or courses directly or indirectly.

 

10.10 Impersonate any person or entity or provide false information (e.g. disguise your identity or the origin of any message) on our services.

 

10.11 Conduct any activities to trace, or seek to trace another user of Doctor Ho Limited’s services, or otherwise interfere with or violate any other user’s rights to privacy or other rights.

 

10.12 Harvest or collect personally identifiable information about any visitors or users directly or indirectly from our service.

 

10.13 Disable, circumvent, bypass or otherwise avoid any measures used to prevent or restrict our visitors’/ users’ access to our services, by hacking, password mining, or other illegitimate or prohibited means.

 

10.14 Probe or test the vulnerability of our services or any network connected to the our services.

 

10.15 Upload any virus, worm, Trojan Horse, time bomb, web bug, spyware, malware, or any other computer code, file, or program that may or is intended to damage or hijack the operation of any hardware, software, or telecommunications equipment, or any other actually or potentially harmful, disruptive, or invasive code or component.

 

11. Course booking, service fee and your obligations

 

By using our service and/ or registering/ booking/ joining any of our courses for parental learners, you must fully acknowledge, understand and agree with the following:

 

11.1 Before booking our course, you agree that you are responsible for reading and understanding the full descriptions of our courses, Privacy Policy, Cookies Policy, Terms and Conditions, and Terms of Use.

 

11.2 Booking our courses for parental learners can be made online via our website https://www.doctorho.co.uk, which contains information regarding our course fees.

11.2.1 We may or may not set time limits for early and late bookings.

 

11.3 The person making the course booking must be 18 years old or older.

 

11.4 To book a course for parental learners, please click ‘Book Online’ and select an available course/module which you would like to book. Joining our courses and/or using our services are subject to successful payment of course and associated fees, as determined by us in our sole discretion.

 

11.5 Payment can be made online during course booking, which is directly managed and processed by Wix Payments - our designated payment service provider.

 

11.5.1 Wix Payments is responsible for collecting and processing all our customers’ payment and payment-related data. Please read carefully about our Privacy Policy on Data privacy related to data collection for payments. The processing of payments shall be governed by such their terms of service. We are neither a party to nor are responsible their actions. 

 

11.6 All fees must be paid in full and in advance using one of our payment methods specified in our website before you join our courses. We do not accept deposit, partial or instalment payments for our courses.

 

11.7 You must fully acknowledge, understand and agree that the course fee for each course for parental learners includes only the one-time online course which is delivered livestream. No other services are included in the course fee. Please note that no play back for any part of our courses will be available after the course is delivered.

 

11.8 Once your course booking is successful and upon successful receipt of the course fee payment, we will email you an online link with the joining instruction to join and access the course using the email you have provided us.

 

11.8.1 The online link enables you to join the livestream course which you have registered for a specific date and time only. You are responsible to promptly attend the course you have registered. Any person who arrives late or is absent during the course will not be rescheduled or refunded.

 

11.8.2 You must keep the online link safe and not to share with anyone else. You must not invite anyone to join the course using the link given to you unless you obtain permission from us (see Terms and Conditions for Parental Learners 8.5).

 

11.8.3 We will only send the online link with the course joining instructions to the email provided to us. We will not be liable to refund the course fee or reschedule the course if you missed the course due to an incorrect email address or incorrect information provided to us. If someone (e.g. an employer) books a course for another person (e.g. an employee), it is the responsibility of the person who books the course to ensure that the recipient of the course receives the joining instructions.

 

11.8.4 Before you start the course, it is your responsibilities to make sure that you have all the suitable equipment and environment to start the course (e.g. a workable computer, tablet or mobile phone, headphone/ earphone, adequate lighting, good Internet connection, a safe, comfortable and quiet environment etc.), and for all fees and expenses associated with the foregoing.

 

11.8 Our courses start promptly according to the schedule advertised on our website and we will not be responsible for any part of the course which you missed due to your technical problems, errors or difficulties.

 

11.10 The fee we charge for using our services/ for our courses for parental learners are listed on the website. Additional information about possible transaction fees and any taxes is available on the payments page. We reserve the rights to change our course fees at any time in its sole discretion. We will update the information in our website and/or notify our users by email regarding such changes.

 

11.11 All fees paid to us should be in GBP. You should be responsible for paying taxes where applicable, in relation to any payments made by you. If Doctor Ho Limited is obligated to pay taxes for the fees payable by you, and if such taxes were not collected from you for original transactions, such taxes may be added to the payment of any outstanding Fees.

 

11.12 You must not register or book a course on someone’s behalf unless you have sought an informed consent from the person you would like to book the course for, for example, an employer must seek an informed consent from their employees if an employer would like to book a course for their employees. We reserve the rights to request to check such consent.

 

11.13 You must not misuse any financial sources or means of others to book a course for yourself or others. We reserve the rights to report such incidents to the relevant authorities, cancel your course booking and permanently terminate your use of our service without giving any notice.

 

11.14 All users are responsible for the accuracy of their personal and payment details when booking for our services/ courses. Please ensure that you check and correct any input errors before confirming your booking for our course. If you book our courses by error, you must inform us by writing using our online contact form or email at the earliest possible time to get a refund. We will deduct any administration cost, currency exchange fees, transaction fees, and any third parties fees where appropriate and applicable. If you fail to notify us more than 48 hours after you have booked a course by error, we will not be able to refund you.

 

11.15 Refunds will be made only to the person who made the original booking using a legitimate payment method.

 

11.16 If you are using payment methods other than stated in our website, you should be responsible for any additional costs (e.g. any third parties transaction or administration fees, currency exchange fees etc.).

 

11.17 We recommend that you check if any additional fees you may be charged by third parties in connection with the purchase of our courses/ service (e.g. international transaction fees, currency exchange fees, or fees due to banks or credit card companies). Doctor Ho Limited is not responsible for any such additional fees or costs.

 

11.18 It is your responsibilities to check with third parties (e.g. your bank or other financial provider) that the amount you have paid for the course is consistent with the course fee specified on our website. We are not responsible for paying any difference of fee incurred by a third party.

 

11.19 By proceeding to the payment page and before paying for the course, you affirm that you have fully acknowledged, read, understood, and agreed with our Privacy Policy, Cookies Policy, Terms and Conditions, and Terms of Use. Please contact us or our payment service provider (Wix Payments) if you have any questions.

 

12. Invoices/ receipts

 

12.1 We will issue and email you an invoice/ receipts for any payment of fees or refund made to or by Doctor Ho Limited. You are responsible for providing us an accurate and valid email address for the purpose of issuing the invoice (please also read our Privacy Policy).

 

13. Discounts/ concessions for course fees

 

13.1 Doctor Ho Limited shall have the sole rights to change or adjust course fees at any time and with immediate effect. Changes of course fees will be updated on our website.

 

13.2 Discounts or concessions may be applied to the public, selected groups or individuals at the sole discretion of Doctor Ho Limited. At Doctor Ho Limited, we would be happy to consider offering discounts in our courses for parental learners for parents or carers who have financial difficulties and are interested in joining our courses. Please contact us for details.

 

14. Cancellation and refund policy

 

14.1 You can cancel or reschedule your course by writing to us by email or using our online contact form at least 28 calendar days before your course starts. Full refund minus administration cost (i.e. online transaction fee where applicable) or an option to reschedule (subject to availability) if an user cancels a course for parental learners at least 28 calendar days before the course starts. Rescheduling a course for parental learners is subjected to availability.

 

14.2 No refund can be made if an user cancels a course for parental learners less than 28 calendar days before the course starts.

 

14.2.1 If you plan to book a course which is due to start in less than 28 days, there will be no option for cancellation or rescheduling.

 

14.2.2. If you have booked a course which is due to start in less than 28 days and, we will not be able to refund or reschedule the course if you change your mind.

 

14.3 You will not be able to cancel the course or get any refund once you have joined or attended any part of the course.

14.4 If there are circumstances that we are unable to deliver a course which a user has already paid for, the user will be entitled to a full refund of what he/she has paid.

 

14.5 Refunds will be made only to the person who successfully made the original booking using a legitimate payment method.

 

14.6 Please note that as the cancellation process and refund may take a few days.

 

​14.7 Please ensure that you check and correct any input errors before confirming your booking for a course, or making any payment. If you book our courses by error, it is your responsibility to inform us by writing an email or using our online contact form at the earliest possible time to get a refund. We reserve the rights to deduct any administration cost, currency exchange fees, transaction fees, and any third parties fees where appropriate and applicable. If you fail to inform us within 48 hours after you have booked a course by error, we will not be able to refund you.

15. Chargebacks

 

15.1 Any refund you received may be different than the amount you paid due to changes in currency exchange rate, third-party fees or other administration fees where applicable.

 

15.2 We reserve the rights to charge the user retrospectively for attending a course without a prior and full payment for the course, as permitted by the applicable law.

 

15.3 We reserve the rights to refuse a notice of cancellation that has been given by an user in bad faith, as permitted by the applicable law.

 

15.4 Please carefully check the Terms and Conditions of our courses before booking, as some course fees may be non-refundable.

 

15.5 Please contact us if you have any questions regarding a payment made by you.

16. Copyrights and intellectual property

16.1 We retain the copyrights of all the content and materials used in our courses for parental learners and website. No part of our courses for parental learners (or their content), learning materials and information of our website can be copied, recorded, shared, reproduced, published, or transmitted without prior consent from us.

16.2 All rights, title and interest in and to our services, including any and all copyrightable materials or any other content thereof which is or may be subject to any intellectual property rights under any applicable law (including any text, artwork, graphics, photographs, images, videos, music, applications and other media, designs, animations, interfaces, documentation, derivatives and versions thereof, logos, domains, customized URLs, trademarks, service marks, trade names and other proprietary identifiers, whether or not registered and/or capable of being registered, and any derivations thereof), are owned by and the exclusive properties of Doctor Ho Limited, and you agree not to sell, license, modify, distribute, share, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

17. Your feedback and suggestions

 

17.1 You acknowledge and agree that we will review your comments, feedback or suggestions about our services and courses, and may take actions to: (i) further improve, analyse, develop, or customise our services, (ii) provide ongoing assistance and technical support, (iii) contact you for a follow up, (iv) offer promotions and monitor performance, (v) prevent fraud and enhance our data security, and (vi) comply with any applicable laws and regulations.

 

17.2 With your consent, we may publish your feedback and comments about our services and courses on our website.

 

17.3 You warrant that your feedback and comments are accurate, complete, and does not infringe on any third party rights.

 

18. Rights to terms changes and updates

 

18.1 We reserve the rights to change our Terms and Conditions and Terms of Use (as well as Privacy Policy and Cookies Policy) at anytime and at our sole discretion.

 

18.2 Any changes of Terms and Policies will be published on our website, please review our Terms and Conditions and Terms of Use (as well as Privacy Policy and Cookies Policy) regularly.

 

18.3 You acknowledge, understood and agree that your continued use of our website and/or our service after any changes of Terms and Conditions and Terms of Use (as well as Privacy Policy and Cookies Policy) constitutes your acceptance of the new Terms and Policies. If you do not agree to any of these Terms or any future version of the Terms, please do not use or access (or continue to access) our website or services.

 

19. Rights to service changes and updates

 

19.1 We reserve the rights to change, adjust, amend, suspend or terminate any of our courses/services for parental learners, and/or cancel your access to any of our courses/ services for any reasons with or without prior notice in any manner and at any time, without liability for any reasons, or for no reason.

 

19.2 We will inform you if any changes of courses/services for parental learners involve changes of course/ service fees, and you can decide if you accept such changes. We may cancel/ terminate the course and service, or provide you with alternative services where available and possible at our sole discretion if you do not accept such changes of course/ service fees.

 

20. Rights to suspend or cancel user account

 

20.1 We need to be able to avoid misuses of our website or service by users/ visitors, and/or avoid illegal activities conducted on our website. Accordingly, we reserve the sole rights to suspend or terminate access to the course and/or service by any of our visitors/users without any notice and liability for any reasons.

 

20.2 You agree that Doctor Ho Limited will not be liable to you or to any third parties for any modification, suspension or discontinuance of our courses or services.

 

21. Notices of changes and updates

 

21.1 We provide our visitors/ users with notices of changes and updates of our services, courses, Terms and Conditions, Terms of Use, Privacy Policy and Cookies Policy in any one of the following methods: (i) publications on our website; (ii) by contacting you using the information which you provided us (e.g. e-mail address, phone number or mailing address); (iii) via our services (e.g. newsletter, or elsewhere).

 

21.2 Our notice to you will be deemed received and effective within twenty-four hours after it is published or sent through any of the above methods unless otherwise stated.

 

22. Marketing and promotional notices

 

22.1 You acknowledge, understand and agree that, with your consent, we may send marketing and promotional notices to you by the contact information which you have provided us (e.g. emails, phone calls, text messages, mails etc.). If you don't want to receive any marketing or promotional notices from us, please let us know at any time. 

 

23. Disclaimer of warranties

 

23.1 By using any of our services, you acknowledge, understand and agree that there are certain risks dealing with any third party services through or in connection with our services (e.g. from our website provider and payment provider). We do not and cannot guarantee any specific outcomes from such use and/or interactions. By using our service, you acknowledge, understood and agree that you have accepted all such risks, liabilities and/or harm of any kind arising in connection with and/or resulting from such use and/or interactions.

 

24. Limitation of liability
